My cousin (age 27) who lives in NYS is claimed as a dependent by his mother. She is head of household. He is self-employed/single/no kids and made $2750 or so profit last year via landscaping. Does he have to file? I told him no since he does not make enough, but what do I know. He told me he would have to pay federal around $300 and $0 for state

I don't think he has to file if earned income was less than the standard deduction

Did he receive a 1099? If so, he has to file (especially if he owes)
No 1099. He started in Jan 2019 and only worked by himself. He was paid in cash only and didn't have much work

He has to file if self employment income is greater than $400. Evidently it is since he owes $ 300. He would also be eligible for EIC which would help.

If he didn't receive a rebate based on 2018, he should file to receive a $ 1,200 rebate as well


PS: If you owe money, that's an indication you have to file :)

Thank you Willie....also, his mother was allowed to claim him as a dependent since he lives with her and makes less than $4200 I believe. Is that correct?

I'm telling him to claim himself to claim the rebate, if he hasn't received one yet.

If his mother claimed him already, he'd have to file a paper return. She'd lose $ 500, but he'd pick up $ 1,200 plus EIC

If he already received his rebate, then let mom claim him

Yes they did

I also believe it states you can't make more than $4200 in that year if someone claims you as their dependent

He did not file as of yet, waiting till the 15th. His mother did back in Jan and she got the $1200. He tried to get it 2 months ago, but was declined since his mother claimed him as her dependent

Did not need a 1099....and yes he worked in 2019 as stated and made close to $3k self-employment.

His mother claimed head of household and he made less than $4200

Questions I would ask

Did she live with the Aunt? Did her aunt support her? Was her aunt putting her through college?

There are times the aunt claiming the dependency exemption is legitimate, but not always

I will also suggest that how tax returns were filed in February or March of 2020 might be different than how they are filed since the pandemic relief legislation has been passed
